On 12 April 2023, the Home Office issued new guidance for the EU Settlement Scheme (EUSS) following the Statement of Changes laid out in Parliament last month. The main guidance for EU, other EEA and Swiss citizens (and their family members) is here.

For applicants who have a pending prosecution, caseworkers are no longer required to hold an application for at least 6 months (as long as other criteria to progress the application are met). For the full suitability guidance, please find it here.

Regarding guidance for Zambrano carers, guidance for family members of a qualifying British citizen, and guidance for those with a derivative right to reside (also known as Chen and Ibrahim / Teixeira cases), minor changes have been made to reflect the recent Statement of Changes.

The Home Office has also released entirely new guidance for gender identity and sex markers on documents. Applicants whose name and/or facial image does not currently match their identity documents are entitled to have their applications processed. However, the caseworker cannot record an applicant’s change of gender (or name) until all of the applicant’s identity and travel documents match.
