What is the Global Talent visa ?

This route is suitable for individuals who are leaders (or potential leaders) seeking to work in the UK in the fields of science, engineering, medicine, humanities, digital technology, arts, and culture (including film and television, fashion design and architecture).

This route replaces the Tier 1 (Exceptional Talent) category. If you held permission to remain in the UK under the Tier 1 (Exceptional Talent) route, you will be able to apply for further leave to remain/indefinite leave to remain under the Global Talent route if you meet the requirements.

The visa process

There are two stages you will need to complete:

Stage 1:

Before you submit your visa application, you will need to apply for an endorsement by a Home Office approved endorsing body. There are separate endorsing bodies for each field, and each have their own individual requirements. The relevant endorsing bodies are:

  1. The Royal Society
  2. The Royal Academy of Engineering
  3. The British Academy
  4. Arts Council England
  5. Tech Nation
  6. UK Research and Innovation (UKRI)

If approved, you will receive an endorsement letter, but the final decision will be recorded on Atlas, a programme which the Home Office has access to.

Stage 2:

Once you receive your endorsement letter, you can apply for entry clearance or leave to remain.

What are the requirements of the Global Talent Visa (initial applications)?

In order to qualify for a Global Talent visa, you will need to demonstrate that:

  1. You are at least 18 years of age
  2. You have undergone screening for active pulmonary tuberculosis, and you have been issued a certificate to confirm that tuberculosis is not present (if you are from a country that falls under Appendix T)
  3. You will need to score 70 points by ensuring that:
  • You have been issued with an endorsement letter by a Home office approved endorsing body
  • The date of application is no more than 3 months after the date on the endorsement letter
  • The endorsement has not been withdrawn by the endorsing body

Do I require maintenance funds?

No. There is no maintenance requirement.

Can I switch into the Global talent visa category?

You can apply outside the UK, but it is also possible to switch into this category from within the UK as long as you do not have, or were not last granted permission in one of the following categories:

  • Visitor
  • Short-term Student
  • Parent of a Child Student
  • Seasonal Worker
  • Domestic Worker in a Private Household
  • Outside the Immigration Rules

What is the length of leave granted?

When applying for your visa, you will need to indicate how long you intend to work in the UK. The maximum leave permitted under this route is 5 years. You can select 1, 2, 3, 4 or 5 years as the desired length of leave.

The amount you need to pay towards the Immigration Health Surcharge will be determined by the number of years you select. See below fees.

You can subsequently apply for further leave to remain or indefinite leave to remain should you satisfy the requirements.

Further leave to remain applications:

You may apply for further leave to remain in the UK should this be required. There is no maximum number of years that you are permitted to remain in the UK under this route.

In order to qualify for further leave to remain:

  1. You will need to ensure that your endorsement has not been withdrawn by the Home Office.
  2. You will need to prove that you have earned money in the UK during your last grant of leave in the chosen field.
  3. You will need to ensure you do not fall for refusal under the general grounds.

Indefinite leave to remain applications:

In order to qualify for indefinite leave to remain you must:

  1. Satisfy the KoLL requirements (CEFR level B1 English language test by an approved centre and the Life in the UK test).
  2. Demonstrate that you did not spend more than 180 days outside the in any given 12 months during the qualifying period relied upon i.e. 3 or 5 years.

Absences directly related to your work will not be counted if you work in one of the following fields: science, engineering, humanities and medicine.

You may apply for indefinite leave to remain in the UK if you were continuously resident in the UK for 3 years and you were endorsed by The Royal Society, The Royal Academy of Engineering or The British Academy criteria or UK Research and Innovation (UKRI) or under the exceptional promise criteria by the Arts Council England or Tech Nation.

You may apply for indefinite leave to remain in the UK if you were continuously resident in the UK for 5 years and you were endorsed under the exceptional promise criteria by the Arts Council England or Tech Nation.

Time spent under the following categories may be combined towards the qualifying period:

Global Talent (including Tier 1 (Exceptional Talent)

Tier 1 (General)

Tier 1 (Entrepreneur)

Tier 1 (Investor)

Skilled worked including Tier 2 (General)

Tier 2 (Minister of Religion), Tier 2 (Sportsperson) and innovator.

Can my dependents join/accompany me to the UK?

Yes, your partner and any children under the age of 18 may accompany or join you as your dependant(s).

What are the conditions of leave to remain?

  1. You must register with the police if required to do so
  2. You are not allowed access to public funds
  3. You cannot be employed as a professional sportsperson/sports coach
  4. You can only study subject to the restrictions set out in Appendix ATAS

What are the fees?

When applying for your endorsement, you will need to pay the endorsement fee of £456. There is a fee of £152 for initial global talent visa applications (+ £608 for each dependent).

However, if you are from one of the following “eligible categories”, the application fee will automatically be reduced to £97 (for main applicant only):

Austria, Belgium, Croatia, Republic of Cyprus, Czech Republic, Denmark, Finland, France, Germany, Greece, Hungary, Iceland, Ireland, Italy, Latvia, Luxembourg, Malta, Netherlands, North Macedonia, Norway, Poland, Portugal, Slovakia, Spain, Sweden or Turkey.

Further leave to remain applications attract a fee of £608 while applications for indefinite leave to remain attract a fee of £2,389.

You and your dependents will be individually mandated to pay for the Immigration Health Surcharge (at the initial and extension stages). This is usually £624 per year.

The Home Office has published a list of endorsing bodies for Start-up visa applications.  This list of endorsing bodies contains the names of all currently approved Start-up visa endorsing bodies, as well as links to their websites and, where available, details of their application process and endorsement criteria.

Obtaining a Start-up visa endorsement

Start-up visa endorsement letter

If your application to be endorsed by a Start-up visa endorsing body is approved, you will be issued with a Start-up visa endorsement letter.  This letter must be submitted as part of your Start-up visa application.  The Immigration Rules contain strict requirements in terms of the information that must be included in a Start-up visa endorsement letter.  Advice from an immigration lawyer will ensure that your endorsement letter satisfies the requirements of the rules.

What else do I need to know about the UK Start-up visa?

As a Start-up visa holder you will not be required to spend any particular amount of time in the UK and you will be permitted to undertake employment other than working for the business or businesses that you have established.

However, you will need to stay in contact with your endorsing body with checkpoints at 6 and 12 months.  The endorsing body will need to be satisfied that you are continuing to work on your business venture and have demonstrated reasonable progress in relation to either your original or a new business idea.  Your endorsement may be withdrawn and your leave curtailed if this is not the case.  You will also need to abide by various other conditions of stay.
