Considering Divorce

If you have decided to bring your marriage to an end, our family law team can manage the process on your behalf from start to finish. As the applicant, you will be responsible for initiating the divorce, but we will handle all the legal documentation and communication with the court.

Responding to Divorce Proceedings

If your spouse has initiated divorce proceedings, you will become the respondent. Once the court issues the application, it will be sent to you for acknowledgement.

Responding to a divorce can be a daunting process, but our solicitors will ensure that your response is properly filed and that your legal position is fully protected. We will guide you through each step, offering reassurance and clarity throughout.

Understanding the Divorce Procedure

In England and Wales, you must have been married for at least one year before applying for a divorce. The procedure generally follows four key stages:

  1. Divorce Application

The process begins when the applicant submits a divorce application to the family court, confirming that the marriage has irretrievably broken down.
A copy of the marriage certificate must be included. If this cannot be located, a certified copy can be obtained from the General Register Office.

Once filed, the court assigns a reference number and sends a copy of the application to the respondent.

  1. Acknowledgement of Service

The respondent has 14 days to complete and return the acknowledgement of service form, confirming receipt of the application.
Unless there are exceptional jurisdictional issues, the respondent cannot contest the divorce.
The court then forwards the acknowledgement to the applicant’s solicitor.

  1. Conditional Order

After a 20-week reflection period, the applicant may apply for a Conditional Order (formerly known as a Decree Nisi).
This step confirms that the court is satisfied the marriage has broken down, though it does not yet legally end the marriage.

  1. Final Order

Six weeks and one day after the Conditional Order is granted, the applicant can apply for a Final Order (formerly known as a Decree Absolute).
Once granted, the marriage is legally dissolved, and both parties are free to remarry or enter into a civil partnership.

Do I Have to Go to Court?

Most divorces can now be processed online without the need for a court appearance.
However, if there are disputes concerning finances, property, or children, a court hearing may be required. Our solicitors will represent you and ensure your interests are fully safeguarded.
